1. The warning
Trading in stocks, options, futures, currencies, cryptocurrencies, and other financial instruments involves substantial risk of loss and is not suitable for every investor. You can lose money — including more than your initial investment. Only trade with capital you can afford to lose entirely.
The features MAKETZO provides — journaling, behavioral accountability, the state machine, COACH SAYS, the strike system, Edge, Pulse, Focus Room, Training Engine, charts, analytics, and any AI-generated content — are tools to support your own decision-making. They do not eliminate, predict, or hedge against the risk of loss. No software product can. Your trading outcomes are determined by your own decisions, your own discipline, your own risk management, and market conditions outside anyone's control.
If at any point you cannot accept the possibility of total loss of the capital you have committed to trading, do not trade. No feature in MAKETZO is intended to encourage you to take on risk you cannot tolerate.
2. Educational purposes only
All content, features, signals, scores, analytics, coaching prompts, AI outputs, training modules, blog posts, newsletters, emails, and any other materials provided by MAKETZO or Abinic, LLC are for general informational and educational purposes only. Nothing on this website or in the product constitutes investment advice, financial advice, legal advice, tax advice, accounting advice, or a recommendation, solicitation, or offer to buy, sell, or hold any security or financial instrument.
This includes — without limitation — any output produced by Maketzo Edge, Maketzo Pulse, COACH SAYS, the Strike System, the Picard Score, the Insights engine, the Training Engine, AI-generated coaching, blog content, the newsletter, and any communication you receive from us by any channel.
3. What MAKETZO is not
MAKETZO and Abinic, LLC are not and do not hold themselves out to be:
- A registered investment adviser (RIA) under the Investment Advisers Act of 1940 or any state equivalent
- A broker-dealer, introducing broker, or member of FINRA, SIPC, or any self-regulatory organization
- A licensed financial planner, certified financial planner (CFP), or fiduciary
- A registered investment company under the Investment Company Act of 1940
- A commodity trading advisor (CTA), commodity pool operator (CPO), futures commission merchant (FCM), or member of the NFA or CFTC
- A money manager, hedge fund, family office, or fund operator
- A custodian of customer funds, securities, or assets of any kind
- A tax preparer, certified public accountant (CPA), enrolled agent, attorney, or legal adviser
- A market maker, exchange, alternative trading system, or order routing service
We do not execute, route, custody, clear, settle, or facilitate any trade or transaction. We do not have access to your brokerage account, your funds, or your positions except insofar as you choose to import data you control. We do not recommend specific securities, sectors, strategies, position sizes, entry prices, exit prices, stop levels, or holding periods for your specific account.
4. No financial, legal, or tax advice
Nothing on this website or in MAKETZO constitutes:
- Investment advice. We do not assess your suitability, risk tolerance, financial goals, time horizon, liquidity needs, or any other factor that a registered adviser would consider in recommending a course of action.
- Legal advice. We are not your lawyer and no information we provide creates an attorney-client relationship.
- Tax advice. Trading produces taxable events. The tax treatment of your trading activity depends on your jurisdiction, classification, holding periods, and many other facts. We do not advise on tax strategy or compliance.
- Accounting advice. We do not provide bookkeeping, audit, or financial reporting guidance.
- Regulatory or compliance advice. We do not advise on whether your trading activity triggers Pattern Day Trader rules, qualified trader status, mark-to-market elections, or any other regulatory regime.
5. Past performance does not guarantee future results
This is the most important sentence on this page. Repeat it back: past performance does not guarantee future results. It applies to your own historical trades, to other traders' results, to backtests, to any chart, screenshot, anecdote, or example on this website, and to any signal or outcome we ever describe in any context.
Markets are non-stationary. A setup that worked last quarter may not work this quarter. A trader who was profitable last year may lose this year. A discipline streak that's helped you for months can break in a single session. Treat every claim of historical success — including your own — with appropriate skepticism, and do not assume that any past pattern, edge, or rule will continue to produce results going forward.
6. Hypothetical and simulated results
Hypothetical, backtested, simulated, paper-traded, and example results have inherent limitations. They do not represent actual trading. Because the trades have not been executed in real markets, results may have under- or over-compensated for the impact of slippage, liquidity, fills, latency, fees, commissions, taxes, emotional decision-making, and other real-world execution factors.
Any hypothetical or example result we display — whether on this website, in marketing materials, in product screens, in the blog, in newsletters, in tutorial content, in onboarding, or in coaching output — is for illustrative purposes only. No representation is being made that any account is likely to achieve profits or losses similar to those shown. Many factors specific to any individual's actual trading cannot be fully replicated in any simulation, and many of those factors materially affect actual results.
7. Signals, scores, and AI outputs
Maketzo Edge and Maketzo Pulse are proprietary signals that produce outputs like "Prime", "Hold", "Exit", "Rising", and "Fading". The Picard Score grades your day on a 1–10 scale. COACH SAYS produces written coaching prompts. The Insights engine produces pattern observations. AI-driven coaching may be added in future. None of these outputs are predictions of future price, profitability, or outcome. They are not buy or sell recommendations. They are not directionally guaranteed.
A "Prime" reading does not mean a trade will be profitable. A "Fading" reading does not mean a position should be closed immediately. A 9/10 Picard Score does not mean tomorrow will repeat. An "Emerging pattern" insight is a statistical observation, not a forecast. The presence, absence, magnitude, or timing of any signal, score, prompt, or insight does not create any obligation on our part and does not warrant any particular outcome.
You are responsible for every trading decision you make. How you incorporate any signal, score, or output into your own plan is entirely your own responsibility.
8. No fiduciary or advisory relationship
Your use of MAKETZO does not create a fiduciary, advisory, agency, partnership, joint-venture, or employment relationship between you and Abinic, LLC or any of its officers, employees, contractors, or affiliates. We have no duty to advise you on the suitability of any trade, asset, strategy, jurisdiction, or vehicle for your specific financial situation, risk tolerance, time horizon, or objectives. That responsibility is entirely yours — or your licensed professional's, if you have one.
9. Instrument-specific risk warnings
Different financial instruments carry different and often substantial risks:
- Stocks (equities). Subject to issuer risk, market risk, liquidity risk, gap risk, and the risk of total loss in the case of bankruptcy or delisting. Small-cap and low-float securities can move violently on low volume and may be subject to short-squeeze, pump-and-dump, or halts.
- Options. Options can expire worthless. Buyers can lose 100% of their premium. Writers (sellers) of options can incur losses substantially greater than the premium received, including unlimited losses on uncovered short calls. Read the OCC's Characteristics and Risks of Standardized Options before trading.
- Futures. Futures are leveraged. Small price moves can produce gains or losses that far exceed the margin posted. Losses can exceed your initial deposit.
- Foreign exchange (forex). The high leverage commonly available in forex trading can work for or against you. Forex carries country, sovereign, and counterparty risk in addition to market risk.
- Cryptocurrencies and digital assets. Volatile, often unregulated or partially regulated, subject to custody risk, exchange failure risk, smart-contract risk, regulatory risk, and the risk of total loss. Digital assets are not deposits and are typically not insured by FDIC, SIPC, or any government agency.
- Leveraged and inverse ETFs. Designed to track daily returns; over longer holding periods, returns can diverge significantly from the underlying due to compounding and decay.
MAKETZO is currently focused on small-cap day-trading discipline. References to other instruments are educational. Trading any instrument other than the one for which you have explicitly developed a plan, risk-management framework, and account suitability is at your sole risk.
10. Margin, leverage, and the Pattern Day Trader rule
Trading on margin amplifies both gains and losses. You can lose more than the funds you deposit. Margin calls can require you to deposit additional funds or close positions on short notice. Your broker may liquidate positions without notifying you in advance to satisfy a margin call.
In the United States, FINRA Rule 4210 (the "Pattern Day Trader" or PDT rule) requires that any margin customer who executes four or more day trades in a rolling five-business-day period in a margin account maintain a minimum equity of $25,000 in that account. Failure to maintain this minimum results in restrictions or a margin call. We do not monitor your account for PDT compliance. That is your responsibility and your broker's responsibility.
Leverage caps and margin requirements vary by jurisdiction, by instrument, and by broker. You are responsible for understanding the rules of your account and your jurisdiction before placing any trade.
11. No warranty of accuracy, completeness, or availability
MAKETZO and all content, features, data, signals, scores, analytics, AI outputs, and educational materials are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by law.
We do not warrant or guarantee:
- Accuracy. Data we display may contain errors, omissions, delays, stale values, or misclassifications. Quote data, fundamental data, and historical data are sourced from third parties and may differ from your broker, your exchange, or other sources.
- Completeness. Any view of your trading activity, performance, or risk reflects only the data we have received and processed. Missing imports, broker discrepancies, corporate actions, currency conversions, or processing errors can produce incomplete pictures.
- Timeliness. Real-time, near-real-time, and intraday data are subject to latency, vendor outages, network conditions, and software defects. No display in MAKETZO should be relied upon as the sole or last word on a market price, position, or condition.
- Availability. The service may be unavailable due to scheduled maintenance, unscheduled outages, vendor failures, infrastructure failures, force majeure, or other causes. We do not guarantee any specific level of uptime or service availability.
- Fitness for purpose. No feature is warranted to be fit for any particular trading style, jurisdiction, account type, instrument, or outcome.
- Non-infringement. No warranty of non-infringement is provided beyond what is required by applicable law.
12. Third-party data and content
MAKETZO uses or may use data, content, or services from third parties — including market-data vendors, brokerage APIs, news providers, image libraries, payment processors, email delivery services, analytics providers, and AI model providers. We do not control these third parties, do not warrant the accuracy or availability of their content, and are not responsible for the consequences of any error, delay, omission, or failure on their part. Your use of any third-party content surfaced through MAKETZO is subject to that third party's terms.
Links from this website to external sites are provided for convenience. We do not endorse the content, products, or services of any linked site and are not responsible for any third-party content.
13. Forward-looking statements
Statements on this website or in the product that are not statements of historical fact — including statements about product roadmap, future features, expected outcomes, market behavior, or our business plans — are forward-looking statements. Forward-looking statements involve assumptions, risks, and uncertainties, and actual outcomes may differ materially. We undertake no obligation to update any forward-looking statement.
Any reference to potential trader outcomes, hypothetical earnings, or expected performance is illustrative only and not a forecast, guarantee, or promise of any specific result.
14. Limitation of liability
To the maximum extent permitted by law, in no event shall Abinic, LLC, MAKETZO, or any of their officers, directors, employees, contractors, agents, affiliates, licensors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost capital, lost data, lost opportunity, lost goodwill, or trading losses of any kind — arising out of or in connection with your use of, or inability to use, MAKETZO, this website, or any content provided through either, whether based on warranty, contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our aggregate liability to you for any and all claims arising out of or related to your use of MAKETZO shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Abinic, LLC, MAKETZO, and their officers, directors, employees, contractors, agents, affiliates, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, expenses, and fees (including reasonable attorneys' fees) arising from or related to: (a) your access to, use of, or reliance on MAKETZO or any content; (b) your trading activity, decisions, or outcomes; (c) your violation of these disclosures, our Terms of Service, or any applicable law or third-party right; or (d) any information or content you submit, post, transmit, or otherwise make available through MAKETZO.
16. Tax and regulatory responsibility
Trading produces taxable events. The tax treatment of your trading activity — including the classification of gains and losses, wash-sale rules, mark-to-market elections, holding periods, qualified-trader status, and the reporting of cryptocurrency and foreign-account activity — depends on your jurisdiction and your specific facts. You are solely responsible for tracking, reporting, and paying taxes on your trading activity and for complying with all applicable laws and regulations, including securities laws, exchange rules, sanctions, anti-money-laundering rules, and the laws of your country and state or province of residence.
Any data export, summary, or report generated by MAKETZO is for your convenience and is not a substitute for proper bookkeeping, broker statements, or professional tax preparation.
17. Consult a licensed professional
If you are unsure whether trading is appropriate for you, consult a licensed financial advisor, CPA, attorney, or other qualified professional before you begin or before making any significant decision. They can assess your specific situation in ways that no software product — including MAKETZO — ever could.
This is especially important if:
- Trading capital represents a meaningful portion of your net worth
- You are funding trading with debt, retirement accounts, home equity, or borrowed capital
- You are trading professionally or for income (regulatory and tax implications apply)
- You have not previously traded with real capital
- You are trading on margin or leverage for the first time
- You are trading from a jurisdiction whose laws you have not independently reviewed
18. Acknowledgment of risk
By accessing this website, creating an account, or using MAKETZO in any capacity, you acknowledge that you have read, understood, and accepted this Risk Disclaimer, the Terms of Service, and the Privacy Policy. You acknowledge that trading carries substantial risk of loss; that no content, signal, score, prompt, or output in MAKETZO constitutes investment, legal, tax, or accounting advice; that you alone are responsible for your trading decisions and outcomes; and that you are solely responsible for evaluating whether trading is appropriate for you, given your specific financial situation, risk tolerance, and objectives.
19. Modifications to this disclaimer
We may modify this Risk Disclaimer at any time, in our sole discretion. Any dispute arising out of or related to this disclaimer or your use of MAKETZO is subject to the dispute-resolution provisions of our Terms of Service, which may include mandatory arbitration and a waiver of the right to participate in a class action.
